1. The service

Inspectaly provides software for recording property inspections and producing reports. It is a documentation tool. It does not provide professional, legal or surveying advice, does not certify a property as safe, habitable or compliant with any code or regulation, and does not replace the judgement of a qualified inspector.

2. Accounts

You must give accurate details, keep your credentials confidential and be at least 18 years old. You are responsible for everything done under your account, including by team members you invite. Tell us promptly at hello@inspectaly.com if you suspect unauthorised access.

3. Plans, trials and payment

• Paid plans are billed per inspector in advance and renew automatically until cancelled.
• Free trials last 14 days and require no payment card.
• Fees exclude taxes, which are added where applicable.
• Prices may change on 30 days' notice, effective at your next renewal.
• Except where the law requires otherwise, payments already made are non-refundable.
• Purchases made through the Apple App Store or Google Play are also subject to that store's terms, and refunds for them are handled by the store.

4. Your content

You keep all rights in the inspections, photographs, notes and reports you create. You grant us the limited, worldwide, royalty-free licence needed to host, process, back up, transmit and display that content so the service works, and to deliver it to recipients you choose. That licence ends when you delete the content or close your account, subject to the retention periods in our Privacy Policy.

You confirm you have the right to enter details about the properties and people you record, and to photograph the premises you inspect.

5. Acceptable use

Do not use Inspectaly to:

• break the law or infringe anyone's rights;
• upload malware or harmful code;
• falsify, backdate or otherwise misrepresent an inspection record;
• scrape, resell or sublicense the service;
• attempt to breach its security or access another customer's data;
• reverse engineer it, except to the extent the law expressly allows.

We may suspend or close accounts that do.

6. Reports and signatures

You are responsible for the accuracy and completeness of what you record and for checking a report before you send it. Electronic signatures collected in the app are intended to evidence agreement between you and your counterparty; their legal effect depends on the law that applies to you and to the underlying agreement.

7. Availability

We aim to keep the service running and to sync offline work reliably, but we do not guarantee uninterrupted or error-free access. Maintenance, updates and events outside our reasonable control may cause downtime. Keep your device backups switched on for work captured offline.

8. Our intellectual property

The software, standard templates, name, logo and design of Inspectaly remain ours. You get a non-exclusive, non-transferable, revocable licence to use them for your own inspection work while your account is in good standing. Nothing in these terms transfers ownership of them to you.

9. Disclaimers and liability

To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.

We are not liable for indirect, incidental, special or consequential loss, for lost profits, revenue or data, or for the outcome of any dispute, claim, deposit adjudication or transaction in which one of your reports is used. Our total aggregate liability arising out of or relating to these terms in any 12-month period is limited to the fees you paid us in that period.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, or for death or personal injury caused by negligence.

10. Termination

You may cancel at any time from your account settings; access continues to the end of the paid period. We may suspend or close an account for material breach of these terms, non-payment or unlawful use.

Export your reports before closing your account: we delete account data within 30 days, as described in the Privacy Policy.

11. Changes to these terms

We may update these terms. For material changes we will give notice in the app or by email at least 30 days before they take effect. Continuing to use the service after that date means you accept the update. If you do not accept it, cancel your account before the change takes effect.

12. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. The state and federal courts located in Sheridan County, Wyoming have exclusive jurisdiction over any dispute arising out of them.

This does not affect any mandatory consumer protection rights you have under the law of the country where you live.
